Dava \u015fart\u0131 arabuluculukta, \u00e7\u00f6z\u00fcm \u015fart\u0131 yoktur ve ilk arabuluculuk toplant\u0131s\u0131ndan sonra mahkeme yolu her taraf i\u00e7in her zaman a\u00e7\u0131kt\u0131r. Kanunen belirlenen iki konuda dava \u015fart\u0131 arabuluculuk vard\u0131r.<br \/><br \/><strong><b>1- Ticari Davalarda Dava \u015eart\u0131 Arabuluculuk<\/b><\/strong><strong><b>:<\/b><\/strong>\u00a06102 say\u0131l\u0131 T\u00fcrk Ticaret Kanununun 5\/a maddesine g\u00f6re, TTK\u2019n\u0131n 4. maddesinde belirtilen t\u00fcm ticari davalar ile di\u011fer \u00f6zel kanunlarda yer alan ticari davalardan, konusu bir miktar paran\u0131n \u00f6denmesi olan alacak ve tazminat talepleri hakk\u0131nda dava a\u00e7\u0131lmadan \u00f6nce arabulucuya ba\u015fvurulmu\u015f olmas\u0131 dava \u015fart\u0131d\u0131r. Yani, arabulucuya ba\u015fvurulup \u00e7\u00f6z\u00fcm aranmadan bu t\u00fcr davalar do\u011frudan asliye ticaret mahkemesine a\u00e7\u0131lamaz.<\/p><p><strong><b>2- \u0130\u015f Hukukunda Zorunlu Arabuluculuk<\/b><\/strong><strong><b>:<\/b><\/strong>\u00a0<\/p><p>\u00a0<\/p><p>7036 say\u0131l\u0131 \u0130\u015f Mahkemeleri Kanunu\u2019nun 3.
